01/20/2012 #1 Motion to waive entry fee, filed by George M. Zegalia, is allowed.
01/20/2012 #2 Petition pursuant to M.G.L. c. 231, ยง 118 with attachments, filed by George M. Zegalia.
01/25/2012 #3 ORDER: To the extent that the petition, filed pursuant to G. L. c. 231, s. 118, par. 1, seeks relief from the court's December 21, 2011 order vacating the court's December 14, 2011 temporary restraining order, the order is not reviewable. See Royal Dynasty, Inc. v. Chin, 37 Mass App. Ct. 171, 172-173 (1994). Construing the temporary restraining order as meeting the requirements for treatment as a request for a preliminary injunction, the apparent treatment given to the request by the trial court, the petitioner may file in the trial court pursuant to G. L. c. 231, s. 118, second par., a notice of appeal of the order vacating the preliminary injunction. See id. at 172-173; Addison v. Belay, 440 Mass 1010 (2003) ("Because the judge's order was in essence, if not in name, a denial of a preliminary injunction, [petitioner] may appeal from that order under G. L. c. 231, s. 118, second par., to the Appeals Court"). See also Packaging Indus. Group, Inc. v. Cheney, 380 Mass. 609, 610-615 (1980). (Grainger, J.) *Notice/Attest.
