12/30/2013 #3 ORDER: After hearing with both parties represented by counsel, the motion for stay pending the filing of a petition for interlocutory appeal is denied. The petitioner previously abandoned an opportunity to secure the relief she now seeks in this court. See Brodsky v. Cook, Suffolk Civil No. 13-00813 (action in which petitioner sought a memorandum of lis pendens dismissed when petitioner failed to appear). The judge noted in dismissing the action that petitioner "declined to exercise" her option to purchase the subject real estate "despite several opportunities to do so." Also, petitioner has not established in these proceedings that she is presently ready, willing and able to exercise that option even if it is made available to her. Lastly, it appears that petitioner may, by other means, preserve her right to pursue damages based on her contract claim against the estate. (Hines, J.). *Notice/Attest/Gibson, J.
