10/28/2010 ORDER: The petition of the plaintiff seeking interlocutory review of an order dismissing claims brought under G. L. c. 93 and c. 93A is denied. After review of the petition, together with the materials submitted in support of it, and the oppositions thereto filed by the respondents, I discern no clear error of law or abuse of discretion by the motion judge.... While a single justice of this Court has authority to modify an order of a trial judge dismissing a count or counts of a complaint, see Gibbs Ford, Inc. v. United Truck Leasing Corp., 399 Mass. 8, 9 (1987), the present case does not provide occasion to do so, for substantially the reasons articulated by the motion judge in the final paragraph of her order denying the petitioner's motion for a report of the case pursuant to Mass.
