05/21/2013 #3 ORDER: On May 8, 2013, the defendant filed a petition, pursuant to G. L. c. 231, § 118 (first par.), seeking review of temporary orders of the Norfolk Probate & Family Court, entered April 1, 2013 and April 29, 2013, in which the court ordered that the plaintiff shall have temporary physical custody of the parties' minor child. As the defendant's petition for review of the trial court's April 1, 2013 order is untimely, that part of defendant's petition is dismissed. See G. L. c. 231, § 118 (first par.) ("A party aggrieved by an interlocutory order of a trial court justice in the superior court department ... may file, within thirty days of the entry of such order, a petition in the appropriate appellate court seeking relief from such order"). As to the trial court's April 29, 2013 order, I find no abuse of discretion or error of law on the part of the trial court judge warranting single justice relief. Accordingly, that part of the petition seeking relief from the April 29, 2013 order is denied. Plaintiff's request for attorney's fees related to his Opposition to the petition is denied.
