02/15/2013 ORDER: The defendant has appealed a decision of the Housing Court in which the court denied his motion to waive appeal bond. The judge entered findings pursuant to G. L. c. 239, § 5, in which he concluded that the defendant was indigent as provided in G. L. c. 261, § 27A, but that the defendant had failed to establish a non-frivolous defense to the plaintiff's summary process action against him. See G. L. c. 239, § 5. (e). While the court is sympathetic to the defendant's situation, following a review of submissions to this court, and after a hearing, the defendant has failed to demonstrate that he has a defense that is not frivolous within the meaning of G. L. c. 239, § 5(e). Accordingly, the order of the Housing Court denying the defendant's motion to waive appeal bond is affirmed. So ordered. (Katzrnann, J.) *Notice/Attest/Edwards, J.
