RE#2 (Revised Action) The appropriate remedey is an appeal from the dismissal of the appeal by the trial court. See Zieminski v. Berkshire Div. Probate & Family Ct. Dept. 408 Mass. 1008 (1990). The MCAD is granted leave to file a notice of appeal from the order dismissing the appeal on 4/28/09. Said notice of appeal is to be filed forthwith in the trial court (Hanlon, J.).
