12/18/2013 #1 Petition pursuant to M.G.L. c. 231, ยง 118 with attachments, filed by Tess & Carlos, Inc., T & C Main Street, Inc., & T & C Main, LLC.^
12/30/2013 #2 ORDER: After due consideration, this petition for review of the Superior Court order petitioner's motion for disqualification of respondent's attorney in the underlying action is denied. Petitioner correctly cites the general principles governing disqualification but has otherwise failed to proffer a persuasive or compelling argument that the application of those principles require disqualification in the particular circumstances of this case. The harm about which the petitioner complains exists, if at all, in the relationship between the respondent and its clients. Petitioner has not established its standing to assert that harm as a basis for the relief it seeks. Further, this court is unaware of any interpretation of Mass. R. Prof. C. 1.7(b) that requires disqualification of respondent's counsel of choice to facilitate petitioner's settlements options. (Hines, J.). *Notice/Attest/Henry, J.
