10/31/2012 ORDER: Defendant Controlled Risk Insurance Company of Vermont has filed a petition, pursuant to G. L. c. 231, § 118 (first par.), which has been joined by defendant Menno Verhave, MD, seeking review of Findings of Fact, Rulings of Law and Order on Plaintiff's Motion to Enforce Settlement Agreement, entered by the Suffolk Superior Court on September 7, 2012. To the extent that the proper avenue of review is by filing a petition with the single justice, rather than by filing a notice of appeal in the trial court, the petition is denied. Upon a complete review of the petition, the judge's Findings of Fact, Rulings of Law and Order, I find no error of law or abuse of discretion warranting single justice relief. Jet-Line Svcs., Inc. v.
