01/13/2011 REVISED ACTION RE#1: The petition is dismissed. In assessing the content of a trial court judgment or order, we give effect to substance rather than to form. See, e.g., Hennessey v. Sarkis, 54 Mass. App. Ct. 152, 154-156 (2002) (giving effect to substance over form in construing a lower court's restraining order as being temporary as opposed to permanent). In substance, the judgment entered in this case was a judgment for possession in six months conditioned on $1500 monthly payments by the defendants. Whether that judgment was proper is a matter to be determined by a full panel of this court, not by a single justice. To insure that the plaintiff's rights are preserved, the time for filing a notice of appeal from the judgment is extended to January 31, 2011. (McHugh, J.) *Notice/Attest.
