09/25/2013 ORDER: The plaintiff, Douglas Weed, appealed from an August 21, 2013, order of the trial judge denying, in part, his motion to waive the filing fee. Pursuant to G. L. c. 261, § 27D, the plaintiff filed a notice of appeal and the record was assembled for transmission to the Appeals Court and entered on September 18, 2013. On September 20, 2013, this Court received notice of an order further reducing the filing fee from the trial court. Prior to entry on the Appeals Court docket, on September 5, 2013, the trial judge undertook a further review of the matter, vacated his previous order, and entered a new order requiring the plaintiff to pay a filing fee of $25 on or before April 1, 2014. The plaintiff has not filed a notice of appeal from the September 5, 2013, order. Accordingly, the appeal is dismissed as moot, as the order from which the appeal was taken has been vacated and no timely appeal has been filed from the second order. So ordered.
