01/18/2013 #3 RE#1: Petitioners seeks review of a post-judgment Superior Court order that dismissed their appeal. Review under G.L. c. 231, section 118 (first para.) is not appropriate. Rather, the proper route of challenge from the dismissal of an appeal is an appeal to a panel of the Appeals Court. See Zieminski v. Berkshire Div. of Probate and Family Court Dept., 408 Mass. 1008, 1009 (1990). As it appears from a review of the Superior Court docket that a notice of appeal was filed, the trial court will assemble the record in the normal course pursuant to Mass.R.A.P. 8 and 9.
