09/03/2013 RE#2: On August 21, 2013, the petitioner filed a motion to docket late that I allowed on August 23, 2013. On that same date, respondent filed an opposition to petitioner's motion to docket late which I did not have the benefit of reviewing prior to my decision to allow the motion. I treat the opposition as a motion to reconsider my allowance of petitioner's motion. After review of all of the papers, I exercise my discretion to find excusable neglect for the late docketing due to the unusual circumstances presented in petitioner's motion. I also find petitioner has established, to the extent required to support such a motion, a meritorious case. Tisei v. Board of Appeals of Marlborough, 3 Mass. App. Ct. 377, 379 (1975).
