01/23/2013 ORDER: Following divorce proceedings and a complaint for modification, Plaintiff seeks interlocutory review under G. L. c. 231, ยง 118 (first para.) of the second paragraph of a Middlesex Probate & Family Court (Kagan, J.) order issued on 11/28/12 following Mother's Motion for Allowance and Payment of Attorney Fees. In addition, Father has filed two motions to stay 11/28/12 orders of the Probate & Family Court: (1) pending his interlocutory appeal and (2) pending his appeal of a separate and final judgment. After review of all of the parties' submissions, no error of law or abuse of discretion below is apparent. Moreover, the judge'S order was entered " [p]ending further order" and there are no exceptional circumstances presented here that would warrant single justice relief. For these same reasons, plaintiff has not demonstrated entitlement to a stay from the single justice. Accordingly, all of the relief sought in all three single justice petitions is denied.
