09/21/2010 ORDER: The defendant has filed a petition pursuant to Rule 12 of the Uniform Rules on Impoundment Procedure, seeking review of a Superior Court judge's order dated September 14, 2010, that denied the defendant's motion to impound four lines from page seven of the "Commonwealth's Statement of the Case" dated September 2, 2010. After review of the petition and its supporting papers, the petition is denied because the defendant has failed to establish that the judge's order constitutes an abuse of discretion or other legal error. To provide the defendant an opportunity to seek further review in the Supreme Judicial Court, the stay of the Superior Court judge's order is continued until 5:00 p.m. on September 23, 2010, or until further order of a single justice of that court.
