11/02/2010 #1 PETITION pursuant to G.L. c. 231, s. 118 with attach, filed by Claudia Toole.
11/05/2010 RE#1: A request for preliminary injunction is always addressed to the discretion of the trial court judge, and a single justice will not interfere with the exercise of that discretion absent a clear error of law or abuse of discretion. See Jet-Line Services, Inc. v. Board of Selectmen of Stoughton, 25 Mass. App. Ct. 645, 646 (1988). After careful review of the trial court order, the petition and documents submitted by both petitioner and the Sovereign Bank, I discern no abuse of discretion or error by the trial court judge in denying the requested relief (Kafker, J.). Notice/attest/Brady, J.
