The judge's denial of the motion to intervene as of right is a final, immediately appealable order, and thus is not reviewable as an interlocutory order under G. L. c. 231, § 118 (first par.). See Attorney Gen'l v. Brockton Agric. Soc'y, 390 Mass. 431, 432-36 (1983); Mass. Fed. Teachers v. School Comm. Chelsea, 409 Mass. 203, 204-205 (1991). Accordingly, the petition must be denied because the subject order is not interlocutory and the petitioner must pursue a plenary appeal by filing a notice of appeal in the trial court.
