06/21/2011 ORDER: The defendant, on June 13, 2011, filed an appeal pursuant to G. L. c. 261, § 27D, from an order of a Superior Court judge that denied the defendant's motion for waiver of fees.(1) The judge's order denied the defendant's request without a hearing and without making findings in support of the denial. Both a hearing on the merits and the preparation of findings and rationale following the taking of an appeal are required under G. L. c. 261, §§ 27C & D. Consequently, the case is remanded to the Superior Court for a hearing on defendant's motion, and for the preparation of written findings and reasons for the denial of the defendant's motion, such findings to be completed and transmitted to the Appeals Court on or before August 12, 2011.
