L. c. 261, § 27D, from the denial, on January 31, 2011, of his Motion to Be Declared Indigent.1 A review of the Superior Court's docket shows that the defendant's notice of appeal was filed on March 11, 2011, forty-two days after the denial of the appellant's motion. Consequently, the appeal must be dismissed as untimely because the defendant did not file a notice of appeal within the seven-day period provided by G. L. c. 261, § 27D. So ordered. Instead, it appears that the order suggests that the petitioner has not properly applied for the appointment of counsel.
