02/21/2012 #2 ORDER: This is the defendant's appeal, pursuant to G. L. c. 261, § 27D, from the denial of his motion for additional funds for the services of a DNA expert witness, Eric Carita. After review of the papers, I conclude that the trial judge appropriately exercised her discretion by thoroughly considering the facts including, in particular, that expenses were incurred without prior judicial approval and the expert witness opinion evidence was found not to be admissible. There is no error of law or abuse if discretion. The Superior Court judge's order entered on January 17, 2012, that denied the plaintiffs' renewed motion for funds, is affirmed.
