05/19/2011 #9 ORDER: The defendant has filed a motion, pursuant to Mass.R.A.P. 6(a), by which he seeks a stay of execution of sentence pending appeal. The relevant factors are set forth in Commonwealth v. Hodge, 380 Mass. 851, 855 (1980); specifically, practical security considerations should the defendant remain at liberty (or, as in this case, be released); and the likelihood of success with respect to the issues asserted by the defendant on appeal. Upon consideration of the defendant's motion for stay of sentence and the opposition of the Commonwealth filed in response, the motion for stay is denied based on the failure of the defendant to demonstrate a meritorious issue on appeal or that he is not likely to pose a risk to the safety of the public. I am especially unpersuaded that the defendant satisfies the first category of consideration discussed in Commonwealth v. Levin, 7 Mass. App. Ct. 501, 505 (1979). (Fecteau, J.).
