03/30/2011 MEMORANDUM AND ORDER: The Commonwealth's motion to dismiss the appeal as moot as the defendant's probation has been revoked as a result of the commission of new crime. Thus, we need not reach the question whether the judge knew he had discretion with regard to ordering the defendant to attend a certified batterer's program in the circumstances of this case. We recognize that we have discretion to decide the case but this issue is unlikely to arise again and in any event, is not apt to evade review. Appeal dismissed. (Cypher, Sikora & Hanlon, JJ.).
