08/08/2011 #2 ORDER: As single justice I review the order before me to determine whether the conclusion that it is reasonable to grant $2,000 of supplemental funds to compensate Frederick Winsmann, Ph. D., rather than the requested amount of $2,700, was an abuse of discretion. In his affidavit, Dr. Winsmann notes that the breakdown of costs he provided "is a projection and an estimate." In light of that I cannot conclude that the judge's order was an abuse of discretion. The judge concluded that some of the amounts estimated by Dr. Winsmann might be high, giving the examples of travel, which the doctor estimated at 4 hours, and the time required for trial preparation and testimony, which the doctor estimated at 8 hours. (The doctor will bill $190 per hour except for travel which will be billed at $60 per hour.) Even if the estimates do turn out to be accurate, the funds allowed by the judge would permit Dr. Winsmann to complete his report and indeed to begin (though not complete) trial preparation and/or testimony. Should the doctor expend the time estimated such that the funds allowed run out prior to his completion of trial preparation and testimony, the order of the judge below, and this order, are without prejudice to the petitioner seeking further funds from the lower court.
