03/20/2012 #4 MEMORANDUM AND ORDER: Following a jury trial in Boston Municipal Court, the defendant was convicted of possession of an unlicensed firearm, and he is currently incarcerated on the sentence related to that charge(1). On appeal, he intends to argue, inter alia, that his motion to suppress the gun should have been allowed, that the trial evidence was insufficient to sustain his convictions, and that his conviction is constitutionally infirm. Before me is the defendant's motion to stay execution of the sentence pending appeal pursuant to Mass. R. App. P. 6(b).(2) Having reviewed the defendant's motion, the memorandum and other papers submitted in support of it, and the cases that the defendant has cited, I conclude that the defendant has not demonstrated a sufficient likelihood of success on the merits to justify his release pending appeal. See Commonwealth v. Allen, 378 Mass. 489, 498 (1979). The motion for a stay is therefore denied. (Milkey, J.).
