08/22/2011 ORDER: The defendant seeks a stay of execution of his sentence pending appeal of his conviction for indecent assault and battery. See Mass.R.A.P. 6(a) and 6(c). The relevant factors are: (1) practical security considerations should the defendant be released and (2) likelihood of success on appeal. Commonwealth v. Hodge (No. 1), 380 Mass. 851, 855 (1980). After review of the defendant's motion and of the briefs filed in this court, even assuming the defendant could meet the standard for allowance of a stay with respect to the prong concerning security, something that I am not in a position to determine on the papers alone and on which I express no opinion, I am not persuaded that the defendant's appeal has a sufficient likelihood of success on the merits to entitle him to the relief sought.
