See Mass.R.A.P. 4(b). Accordingly, the matter is remanded to the Greenfield District Court with instructions that the notice of assembly of the record issued on March 14, 2012, is to be vacated. Neither party is to have costs of appeal. This order of dismissal is without prejudice to filing a notice of appeal upon final disposition of this matter. So ordered.
