02/07/2013 #3 ORDER: The relief being sought by Mr. Hynes is unclear from the papers presented. If he is seeking to file a late notice of appeal from the November 20, 2012, Chapter 209A restraining order of the Ayer District Court, his request is denied, as he has not shown that his failure to appeal in a timely fashion was due to excusable neglect and that he has meritorious appellate issues to raise. See generally, Tisei v. Building Inspector of Marlborough, 3 Mass. App. Ct. 377, 379 (1975). If Mr. Hynes is seeking some other form of relief, he may, on or before February 20, 2013, submit a supplemental filing identifying the specific trial court order(s) that he seeks to have reviewed by the single justice, the court(s) in which they were issued, the date(s) when they were entered in the trial court, a copy of the order(s) at issue, and the reason(s) why he is entitled to relief from the single justice. The supplemental filing must be accompanied by a certificate of service indicating that both his original filing and the supplemental filing were served upon any and all opposing parties. If no supplemental filing and certificate of service are submitted in accordance with this order, this matter shall be dismissed. (Cohen, J.) *Notice/Attest.
