The defendant, having now successfully obtained relief from his convictions in the trial court, has filed an assented-to motion to dismiss the appeal. The appeal is hereby dismissed without costs to either side. A copy of this order, which shall constitute the rescript, shall be provided forthwith to the Appeals Court for entry on its single justice docket (12-J-395) , indicating that the appeal from the single justice's order has been dismissed"
