01/24/2008 RE#2 Rule 14(b) of the M.R.A.P. confers jurisdiction on the appellate court or a single justice to enlarge the time to file a notice of appeal, provided that the notice is filed within one year of the judgment or order to be appealed. Where there has been an untimely notice of appeal filed during that year, the jurisdiction of the appellate court to consider a motion to enlarge the time,nunc pro tunc, is not terminated on the one-year anniversary date. See Comm. v. White, 429 Mass. 258, 263-265 (1999); Comm v. Abreu, 66 Mass.App.Ct 795, 798 (2006).
