The petition must be denied because the ultimate relief requested is outcome determinative. See Mass.R.A.P. 15(c)("a single justice may not dismiss or otherwise determine an appeal or other proceeding"). Additionally, the petition can be denied for the reason that it has not been established that the motion for reconsideration raised any substantially new matter from that which was presented in the prior motion.
