02/27/2012 #9 ORDER: The Plaintiffs ("Coalition") in these consolidated cases seek a stay of execution of certain orders of the Superior Court entered on December 12 and 22, 2011 and January 27, 2012, as more particularly described in their petition for relief. The Coalition is not entitled to a stay or other injunctive relief unless they demonstrate a likelihood of success on the merits.See Wilson v. Commissioner of Transitional Assistance, 441 Mass. 846, 851, 858 (2004) (vacating preliminary injunction because plaintiff failed to demonstrate any likelihood of success on the merits). This court must be mindful of the proposition that "[w]hat matters as to each party is not the raw amount of irreparable harm the party might conceivably suffer, but rather the risk of such harm in light of the party's chance of success on the merits." Packaging Indus. Group, Inc. v. Cheney, 380 Mass. 609, 617 (1980). Based upon my careful review of the orders and judgments entered below and the comprehensive and well written memoranda submitted by the parties, the Coalition has not demonstrated the requisite likelihood of success to warrant intervention by the Single Justice. Accordingly, the Coalition's motion is hereby DENIED. (Agnes, J.) *Notice/Attest.
