01/23/2013 ORDER: In a petition for rehearing, the appellees assert for the first time before us that there is no genuine issue of material fact with respect to retaliation because the probationary clause this court found unlawful was removed prior to the appellant's termination. Changes to the text of paragraph 18 were not made, however, that were offered to the appellant in exchange for his agreement to include the probationary paragraph. Consequently, having considered this and all other arguments in the petitions for rehearing filed by the appellant and the appellees, it is ordered that the petitions be, and the same hereby are, denied.
