11/16/2012 ORDER: The defendant, Arturo Oliveira, has appealed a decision of the Housing Court, in which the court denied his motion to waive appeal bond. The judge entered findings pursuant to G. L. c. 239, § 5, in which he concluded that the defendant was not indigent as provided in G. L. c. 261, § 27A. Following a review of submissions to this court, including the order on the defendant's motion to waive appeal bond, and after a hearing at which both parties appeared, the defendant has failed to demonstrate that he is indigent as provided in G. L. c. 261, § 27A. Accordingly, the order of the Housing Court denying the defendant's motion to waive appeal bond is affirmed. (Sullivan, J.). Notice/attest/Winik, J.
