09/15/2006 RE#1: The defendant's petition requests the single justice to vacate the Superior Court judge's allowance of the plaintiff's motion to file a third amended complaint, and to enter an order denying the plaintiff's motion. The petition must be denied because the single justice is without authority to grant the relief requested insofar as it would be outcome determinative. See Mass.R.A.P. 15(c). Although the petition does not request leave to take an interlocutory appeal of the order, I have reviewed the petition and determine that it fails to establish an abuse of the considerable discretion afforded to trial court judges in these matters that would warrant my granting leave for an interlocutory appeal.
