08/23/2011 ORDER: Pursuant to G. L. c. 231, § 118, first par., the third-party defendants, John D'Ambrosio and D'Ambrosio & Co., petition for interlocutory review of the denial of their motion for partial summary judgment. To the extent that the petition seeks entry of an order allowing its motion for summary judgment, it seeks relief a single justice has no authority to provide. See, e.g., Shaw v. Royal & Sunalliance Ins. Group, 2006-J-387 (August 18, 2006); Mass.R.A.P. 15(c), 365 Mass. 860 (1974). To the extent it seeks interlocutory review by a panel of this court, the petition fails to demonstrate that this case merits such extraordinary, rarely granted, and highly disfavored relief. The petition is therefore denied. (Rubin, J.) *Notice/Attest. Footnotes: (1) Donna Mills (2) John E. Rogers and Michael D. Hartigan. (3) D'Ambrosio & Co.
