11/26/2012 #3 Trial court docket, received from Quincy District Court.
11/26/2012 #4 RE#2: To the extent you are seeking leave from the Single Justice to file a late notice of appeal from the issuance of a G.L. c. 258E harassment order, you may file a motion requesting such leave, on or before December 7, 2012, and in which you include a memorandum that establishes excusable neglect for the late filing and a meritorious appellate issue. See Tisei v. Building Inspector or Marlborough, 3 Mass. App. Ct. 377, 379 (1975); Mass. R.A.P. 14(b). (Kafker, J.). *Notice/Attest/Orfanello, J.
12/06/2012 #5 Letter from Carolyn Robison re: reasons why appeal hearing is needed. ^
12/19/2012 ORDER: To the extent Petitioner is seeking leave from the Single Justice to file a late notice of appeal from the issuance of a G.L. c. 258E harassment order, it appears that such an appeal may be moot pursuant to O'Brien v. Borowski, 461 Mass. 415, 417, 430 (2012) (finding that issues relating to an expired harassment prevention order are moot). Treating Petitioner's letter, dated December 3, 2012, as a motion requesting such leave, I deny it without prejudice to renewal on or before December 27, 2012 in which Petitioner specifies the date of the District Court order/final judgment from which an appeal is sought, the expiration date of such order, and citation to any legal authority providing a right to appeal from such order. (Sikora, J.). *Notice/Attest/Orfanello, J.
05/07/2013 SUPPLEMENTAL ACTION RE#2: As the petitioner did not file a renewed motion to file a late notice of appeal with the single justice within the time frame established by his 12/19/12 order, the petition is dismissed. (Kantrowitz, J.). *Notice/Attest/Orfanello, J.
