06/28/2012 #2 ORDER: The defendant, Christopher Kilroy, has filed a petition for interlocutory review, pursuant to G. L. c. 231, § 118 (first par.), in which he seeks to have the Single Justice (1) vacate a Superior Court judge's order allowing a motion to vacate the dismissal of the complaint and enter an order dismissing the complaint; and (2) in the alternative, to allow an interlocutory appeal to a full panel of this court. The Single Justice does not have the authority to grant outcome-determinative relief. Mass. R. App. P. 15(c). In addition, upon review of the papers, and particularly the motion judge's comprehensive and thoughtful memorandum, I see no reason to grant the extraordinary relief of allowing an interlocutory appeal of the order below.
