08/23/2012 ORDER: The plaintiff appeals from a denial of his motion for waiver, substitution or state payment of a filing fee. General Laws c. 261, §27( C) (4) states, in relevant part: The court shall not deny any request without first holding a hearing thereon; and if there is an appeal pursuant to section twenty-seven D following a denial, the court shall, within three days, set forth its written findings and reasons justifying such denial, which document shall be part of the record on appeal. Since the record does not show that a hearing occurred, nor were findings made, the appeal is vacated as premature and remanded to the Hampden Superior Court (HDCV2012-00589) for the plaintiff to be heard, and for findings and reasons. A copy of said findings and reasons are to be included with the new assembly. (Carhart, J.). Notice/attest/Sweeney, J.
