06/19/2012 #2 ORDER: The defendants, Karen Welch, R.N. and Falmouth Hospital, have filed a petition pursuant to G. L. c. 231, § 118 (first par.), seeking review of the findings of a medical malpractice tribunal. The defendants contend that the plaintiff's offer of proof was insufficient as to the defendants. The defendants' petition requests that the single justice enter an order finding the plaintiff's offer of proof insufficient and to require the plaintiff to post a bond pursuant to G. L. c. 231, § 60B. The defendants' petition must be denied as beyond the scope of the single justice's jurisdiction. Relief under G. L. c. 231, § 118 (first par.) is available with respect to "an interlocutory order of a trial court justice." A finding by a medical malpractice tribunal issued pursuant to G. L. c. 231, § 60B, is not an interlocutory order by a trial court justice. While a Superior Court judge sits as a member of the tribunal, the judge cannot impose a decision on the other members. See Kopycinski v. Aserkoff, 410 Mass. 410, 413-416 (1991). To the extent the Single Justice may have the discretion to grant an interlocutory appeal of the tribunal's decision, I decline to exercise that discretion. Id. at 412. See also Ruggiero v.
