DOCKET ENTRIES
Entry Date Paper Entry Text
12/20/2010 #1 PETITION pursuant to G.L. c. 231, s. 118 with attach and request for hearing, filed by The Phoenix Insurance Company, incorrectly sued herein as the Travelers Property Casualty Company d/b/a The Phoenix Insurance Company.
12/20/2010 #2 Notice of withdrawal as counsel for the petitioner, filed by Richard L. Neumeier.
12/22/2010 #3 ORDER: In reliance upon the signed representations of counsel for defendant, Phoenix Insurance Company, that Jay S. Fishman occupies no relationship with that company as an officer, director, or employee (Request for Hearing at P.2) this court hereby excuses him from compliance with the Superior Court's order of November 26, 2010, commanding him to sign and submit an affidavit verifying that he has read and understood that court's Memorandum of Decision dated November 26, 2010. Additionally, I hereby extend the time for compliance with the Order of November 26, 2010, by Alan D. Schnitzer as vice chairman and chief legal officer of defendant, Phoenix Insurance Company, through the close of December 31, 2010. Compliance by Mr. Schnitzer need only consist of his confirmation that he has read the Memorandum and Order of November 26, 2010. He need not confirm that he has "understood" the Memorandum and Order because that term remains controversial in the circumstances of that dispute. See the Order of December 20, 2010, in Deskos v. Shagoury Insurance Co. Agency, et al, Docket No. 10-J-565. The court continues to exercise authority over this unusual dispute upon the basis of a qualified view of its jurisdiction and upon concern over the escalation of confusion and contention in the absence of some immediate appellate forum. 12/29/2010 #4 Motion for extension of time or, in the alternative, for leave to submit a substitute affidavit, filed by Phoenix Insurance Company, improperly named as Travelers Property Casualty Company.
