01/10/2018 RE#1: The petition pursuant to G. L. c. 231, s. 118 (first para.) seeks review of a margin order entered by the Superior Court on December 7, 2017. This petition, which was not filed in the Appeals Court until January 9, 2018, is untimely under the statutory and, therefore, non-extendable thirty-day filing period set forth in G.L. c. 231, s. 118. See McGrath v. McGrath, 65 Mass. App. Ct. 670 (2006). Accordingly, the petition must be dismissed. Notwithstanding, to the extent a party seeks to appeal an order denying a motion to compel arbitration pursuant to G.L. c. 251, s. 18(a)(1) , such an appeal is initiated by filing a notice of appeal in the trial court and pursuing a plenary appeal to a panel, rather than a petition to the single justice.
