09/03/2013 ORDER: In our Memorandum and Order pursuant to Rule 1:28 dated June 6, 2013, we invited the defendants to submit an application for appellate attorney's fees and costs pursuant to Fabre v. Walton, 441 Mass. 9, 10-11 (2004). They did so, and no opposition has been timely filed. After review of the defendants' application for fees and costs, we consider $9,240.00 in attorney's fees and $105.00 in costs to be fair and reasonable in the context of this case. We therefore allow the application and award to PEG Funding IA LLC and CFA Capital Partners, LLC the sum of $9,345.00. Any proceeding to enforce this order shall be brought in Superior Court.
